Second Amendment Victory Sinks NC “emergency gun ban”

With a tip of the Stetson to David Codrea’s War on Guns for the link, the Second Amendment Foundation has announced a victory over the State of North Carolina in the fight to retain gun rights during an emergency.

Briefly quoting the SAF press release linked above:

In his opinion, Judge Malcolm J. Howard, senior United States district judge for the Eastern District of North Carolina, wrote, “…the court finds that the statutes at issue here are subject to strict scrutiny…While the bans imposed pursuant to these statutes may be limited in duration, it cannot be overlooked that the statutes strip peaceable, law abiding citizens of the right to arm themselves in defense of hearth and home, striking at the very core of the Second Amendment.”

While we have to wait to see if the State appeals, this is a substantial step toward rational gun laws in North Carolina. Congratulations to the Second Amendment Foundation.

Which in all justice is due more than congratulations or other lip service. The link to the SAF tip jar is on the right. And yes, that is a Hint!
